Topic: A New Philosophy of Witness Preparation by John McCabe
Blurb: Most lawyers are taught that deposing an adverse witness comes down to three things: Getting their story, locking them into that story, and getting admissions. To counter, the lawyer defending the deposition often advises their witness to say as little as possible, essentially: “Yes,” “No,” and “I don’t know.” While effectively muting a witnesses can mitigate some risks, the technique comes at an enormous cost if applied across all witnesses. In this presentation, veteran litigation consultant John G. McCabe, Ph.D., will share his “New Philosophy of Witness Preparation.” In it, John emphasizes the importance of a good case story and how that story is told primarily not by the lawyer, but by the witnesses. Each witness, therefore, must be evaluated on two dimensions, their performance and the content of their testimony, to assess each witness’ ability to move the case story forward. It is only after making this determination that a witness can be properly prepared either to play a bit part or a leading role with their testimony.
Bio: John G. McCabe, Ph.D. is the Founder of John G. McCabe Consulting, Inc. Having worked in litigation consulting for 17 years, he specializes in preparing witnesses to testify. John also designs and performs a wide variety of studies (surveys, focus groups, mock trials, etc.) related to jury behavior. Results from these studies have informed trial strategy in a wide range of civil and criminal cases. He earned his Ph.D. from Claremont Graduate University, where his research focused exclusively on juror and jury behavior, bias, and the impact of emotions on legal decision- making.
